Terms of Use

These terms are the deal between you and Brad Brunton for using Etiqo. By using the app you are agreeing to them. We have tried to write them in plain English, because terms you cannot read are not really terms at all.

The short version

Etiqo teaches you about cultural norms and local rules so you travel with more confidence. It is educational, not authoritative. Laws and customs change, they vary within a country, and we can be wrong. Never rely on Etiqo for a decision that affects your safety, your liberty or your legal position. Check an official source.

Read this first

Etiqo is not legal advice, safety advice, immigration advice or travel advice. Do not rely on it as any of those things.

This matters more in Etiqo than in most apps, because Etiqo tells you things like "this is illegal here" and "this can get you fined". Those statements are written to help you understand a place, not to tell you what the law is on the day you are standing in it. Specifically:

Where Etiqo describes laws on alcohol, drugs, religious observance, dress, relationships or LGBTQ+ status, we are reporting what we understand the position to be. We are not endorsing it, and reporting a law is not agreeing with it. Some of these laws carry severe penalties. If any of this could affect your safety or your liberty, please do not make Etiqo your only source. Check your government's official travel advice, the destination's own official guidance, an embassy or consulate, a qualified lawyer, or a community organisation that supports travellers in your situation.

You are responsible for your own decisions when you travel. To the fullest extent the law allows, we are not liable for what happens if you rely on Etiqo.

What Etiqo is

Etiqo is a learning app about cultural norms, etiquette and local rules across roughly 200 countries, with language courses alongside them. It runs entirely on your device, with all its content bundled inside. It does not connect to the internet.

Your licence to use Etiqo

We give you a personal, limited, revocable, non transferable, non exclusive licence to use Etiqo on Apple branded devices that you own or control, in line with the App Store Terms of Service usage rules. We keep ownership of the app itself. This licence is not a sale.

What you agree not to do

Your data

Etiqo collects nothing about you. Your learning progress is stored only on your device, and you can erase it at any time from Settings. The Privacy Policy explains all of this in full and is part of these terms.

Who owns what

The written content in Etiqo, its quizzes, phrases, design and code are ours and are protected by copyright.

Etiqo also builds on work by others, used under their licences. The Acknowledgements page in the app lists each source, its author and its licence, and it is part of these terms. Those materials stay with their own owners under their own licences.

Price

Etiqo is free. Every country, every rule, every quiz, every phrase and every language course is included, with no purchase of any kind, no subscription and no advertising.

A paid option may arrive in a future version, and it may cover content that is free in this one. If that happens, the price and exactly what it covers will be shown to you in the app before you buy anything, Apple will take the payment under its own terms, and you will never be charged without agreeing on that screen.

If something goes wrong

Etiqo is provided "as is" and "as available", without warranties of any kind, whether express or implied. That includes implied warranties of merchantability, fitness for a particular purpose, accuracy, and non infringement. We do not warrant that the content is accurate, current or complete, or that the app will be uninterrupted or error free.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill, or any loss, fine, penalty, detention, injury or harm arising from your reliance on Etiqo's content. Where liability cannot be excluded, our total liability to you for any claim connected with Etiqo is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or fifty US dollars.

Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all the statutory consumer rights your local law gives you, and nothing here takes those away.

Ending this

You can end this agreement at any time by deleting the app. We can end it if you break these terms. The sections on ownership, disclaimers, liability and governing law survive.

The Apple part

Because you got Etiqo from the App Store, a few things need saying about Apple:

Law and disputes

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in it, without regard to conflict of laws rules, and the courts of British Columbia will handle any dispute. If you are a consumer, this does not remove your right to the protections of the mandatory law of the country you live in, or your right to bring proceedings there.

Changes

If we change these terms, we will update the date at the top and ship the new version with the app. Because the terms live inside the app, the version you can read is always the version that applies to the app you are running. Continuing to use Etiqo after an update means you accept the updated terms.
